For Buyers & Sellers

Terms & Legal

01

Purchase Terms

What happens when a buyer and seller transact through ESKA Connect. The final sale itself is agreed directly between buyer and seller; ESKA facilitates and records every step along the way.

Purchase & Sale

ESKA Connect facilitates the introduction, communication, trial and transaction process between a buyer and a seller. The purchase and sale itself is a private agreement between the buyer and the seller; ESKA is not a party to that agreement, but coordinates and records each step so both sides have a clear, shared reference throughout.

Trial & Veterinary Examination

Trials are arranged and confirmed through ESKA Connect, with the seller responsible for presenting the horse fairly and the buyer responsible for evaluating it in good faith. If the buyer wishes to proceed, a Pre-Purchase Examination (PPE) may be carried out by a veterinarian from ESKA's trusted network or one of the buyer's choosing.

The veterinarian's findings are documented and shared with both parties inside the Room. The decision to proceed, withdraw, or renegotiate based on those findings rests with the buyer and seller; ESKA does not interpret veterinary findings on either party's behalf.

Reservation Deposit

Once a buyer wishes to secure a horse ahead of completion, they may optionally pay a 10% reservation deposit. This reserves the horse for an agreed period and forms part of the purchase price.

  • Buyer proceeds: the deposit is credited toward the final payment.
  • Buyer withdraws: if the deposit is applied toward another horse listed on ESKA Connect, the full 10% carries over to that new reservation. If the buyer does not proceed with another ESKA Connect horse, the deposit is retained by ESKA.
  • Seller withdraws: the buyer's deposit is refunded in full.
  • Reservation period expires with no decision made: the deposit is retained by ESKA.

Before any deposit is paid, the buyer and seller receive a Horse Reservation Agreement setting out the reservation period and exactly how the deposit is treated in each scenario, for their review and approval.

Final Payment & Completion

Once the buyer is ready to proceed, the remaining balance of the purchase price becomes due. A sale is considered complete once full payment has been received and processed, at which point ownership transfer and handover are coordinated between the parties.

Both buyer and seller receive confirmation once completion is finalized, and the listing is then marked as sold.

Ownership, Documents & Transfer

Ownership documentation, including the horse's passport, microchip and any applicable federation records, remains the responsibility of the current owner until transfer is complete. Where relevant, ESKA can assist with coordinating UAEERF ownership-transfer requirements, transport, and handover logistics.

ESKA assists and coordinates this process but does not itself act as the registering or federation body; the underlying ownership transfer remains between the buyer, seller, and the relevant authority.

ESKA's Role

ESKA Connect acts solely as a facilitator and coordinator of the introduction, trial, communication, and transaction process. ESKA is not the owner, buyer, seller, veterinarian, insurer, or guarantor of any horse listed or transacted on the platform.

ESKA does not guarantee a horse's condition, suitability, temperament, performance, or future health. Buyers are responsible for their own due diligence, including independent veterinary evaluation and trial assessment, before completing a purchase.

Post-Sale

Following completion, ESKA's involvement covers finalising documentation, assisting with ownership-transfer paperwork, and coordinating transport where requested. All records relating to the transaction remain available inside the Room and are retained by ESKA for reference.

ESKA's role does not extend to the horse's management, welfare, training, or performance once the sale is complete; buyers and sellers are free to communicate directly regarding the horse from that point on.

02

General Terms

These terms apply to everyone using ESKA Connect, whether browsing, submitting a horse, buying, or selling.

Using ESKA Connect

Access to certain features requires an account, and you're responsible for keeping your account details accurate and secure. To maintain a trusted environment, sellers and their listings may go through a verification process, which can include mobile number verification, email verification, and review by the ESKA Connect team.

ESKA Connect is to be used honestly and in good faith; misuse of the platform, its listings, or its members may result in restricted access.

Listings & Information

Sellers are responsible for the accuracy of the information, photographs, videos, pricing, and availability provided in a listing. ESKA reviews submitted listings before publication, but does not independently verify every detail and does not guarantee the completeness or accuracy of third-party information.

Listings remain active for three months from publication, with reminders sent ahead of expiry. Once expired, a listing is automatically removed from public view and may be renewed for a further period if the horse remains available.

Trials & Enquiries

Submitting an enquiry or requesting a trial does not create an obligation for either side to buy or sell. To keep communication clear and properly tracked, all initial enquiries, trial arrangements, and negotiations are managed through ESKA Connect rather than shared contact details.

ESKA may introduce buyers and sellers directly at a later stage of the process. Arrangements made through an ESKA introduction shouldn't be moved outside the platform for the purpose of avoiding ESKA's fees.

Payments

ESKA Connect operates on a commission basis. The price shown on a listing represents the gross sale value agreed between buyer and seller; ESKA's commission is deducted from the proceeds before the balance is settled to the seller.

  • Standard Sale — 7%: for transactions completed through the platform's standard process.
  • Assisted Sale — 10%: where ESKA provides additional support, such as professional photography or videography, listing optimisation, marketing, or negotiation support.

The applicable commission and any deposit terms are confirmed in writing before completion, and a settlement summary is provided once a transaction is finalized.

Confidentiality & Privacy

Horses listed in The Vault are shown only to a small circle of qualified buyers. Sharing any information from there, photos, details, or listings, outside of ESKA Connect is strictly forbidden and may result in legal action under UAE law, as agreed to when requesting access.

Every step that needs a record, the initial agreement, vet reports, and the final sale contract, is kept inside the Room, where both sides can view and download it at any time. Information entered into ESKA Connect is stored securely and never used unprofessionally; ESKA Connect may keep internal notes to support future communication, transaction tracking, and customer service.

Intellectual Property

The ESKA Connect website, branding, and platform materials belong to ESKA Equine. Photography and content submitted by sellers remains theirs, but by listing a horse, sellers grant ESKA a licence to display that media on the platform for the purpose of the listing.

Limitation of Liability

ESKA facilitates transactions but does not guarantee a horse's condition, suitability, performance, or future health, and is not responsible for circumstances beyond its reasonable control, including seller misrepresentations, undisclosed medical conditions, trial-related incidents, or transportation issues.

Buyers and sellers remain responsible for their own decisions, including independent veterinary evaluation and due diligence before completing a purchase.

Disputes & Governing Law

These terms are governed by the laws of the United Arab Emirates. Where a disagreement arises, ESKA encourages direct discussion between the parties first, with ESKA available to help facilitate a resolution, before any formal proceedings.

Changes to These Terms

ESKA Connect may update these terms from time to time to reflect changes to the platform or its services. Continued use of the platform after an update constitutes acceptance of the revised terms.

The specific mechanics for each stage, such as deposit handling, cancellations, and commission, are set out in full in the relevant agreement you're asked to review at that step (for example, the Horse Reservation Agreement or Sale Agreement), which take precedence over the summary above.
